"Being insured is the law in New York"

Consumers have questions and so did we...

• What are the types of insurance coverage and what are the amounts required for the state of New York.

• What does the law say pertaining to minimum insurance coverage in New York?

New York has strict mandatory policies about vehicle registration, insurance coverage minimums, and financial responsibilities pertaining to every vehicle owned, operated, or parked on its roadways. In New York, you can obtain your learner’s permit at sixteen and your restricted license at sixteen and aa half, with a full license at seventeen, with Driver’s Education, otherwise at eighteen.

To adhere to New York's auto insurance rules, you must...

In New York, you must maintain a current insurance policy with a registered insurance company or broker carrying the minimum insurance requirements or greater. There are many different types of insurance, at competitive rates, so shop around for the best price. Be aware that once insured, if you miss a payment on your policy, your insurance could be cancelled, without notice.

1. New York requires each driver to carry third party liability insurance, also called PLPD, accidental benefits coverage, and uninsured and unidentified driver’s coverage, which insures you, in case you injure someone, cause a death, or damage someone’s property in a motor vehicle accident.

In New York, you must have third party liability insurance for bodily injury with each person allowed $25,000.00, up to maximum of $50,000.00, as well as an additional $10,000.00 for property damages. If there are more than two people injured, whoever files first gets the settlement.

2. In New York, you must carry your driver’s license and proof of insurance, which has not expired, in your motor vehicle. If you driver’s license has been suspended, or your insurance has expired, your vehicle could be towed to the compound by the police. You driver’s license can also be suspended if you owe back child support.

Important facts about auto coverage in New York:

• Your driver’s license can be suspended, if you are caught driving without adequate insurance, with too many fines, or driving while under the influence of alcohol or refusing to take a blood-alcohol test, and leaving the scene of an accident or failing to file an accident report. Seat belts are mandatory in New York.
• You are required to change your driver’s license, if you move, within seven days.
• Your insurance agent has access to your driving record to check for fines, suspensions, and accidents that can cause your policy to increase or be cancelled.
• If you are in an accident, and do not have the minimum insurance, you are financially responsible for all injury and damage settlements awarded by the courts.

Comprehensive or collision insurance does NOT meet minimum requirements.

Question: New York State Auto Insurance Collision, needed for financed car?
Does New York State's Auto-Insurance laws require financed cars to have collision on them?

Answer: Yes. Even if they didn't the finance company would require it. In NY, you need a $500 deductible or lower.

Question: Where can I see a list of New York State auto insurance companies with their 3 digit ID?

Answer: I believe you can find this information on your state's insurance site. www.insurance.ny.gov or something similar to that. Since insurance is state governed- you should be able to get help via this site. Hope this helps.

Question: Question about New York Insurance Liability Guidelines -Auto Accident?
I was wondering where I can find the way to look up the Liability Guidelines for New York State. I was in a car accident that the other girl Failed to yield the right of way (she had stop sign and I didnt) so i want to know according to NYS law, what is the highest percentage of liability they can give me when I was clearly not at fault acording to the police report and wittness statements.

Answer: You can visit New York's insurance website. However, the specific payout coverages will be based on your insurance coverage and provisions. Therefore, I recommend that you review your Insurance policy's declaration page and attachments for that information. And, of course, you can also contact your agent or carrier but they will want to know why you are questioning the payout information.

Question: What are the best auto insurance agencies for New York state?
Best and cheapest?

Answer: The real question would be which is best and cheapest for you with your circumstances. If there was one insurance company anyone could point to as absolute best and cheapest, the others would eventually go away. What is best for me, and my circumstances, might be the highest for you. Call an independent agent not connected with just one big company, give him your information, ZIP, type of vehicle, and what coverage you want, he will then look up your driving record and credit rating and the other things they rate you on, and suggest the best for YOU from his data base of available companies in your state.

Question: can a dealer force you to buy GAP insurance, Auto theft insurance in NEW YORK, saying it is bank requirement?
This is a bad credit situatio. Drive Financial is the bank. They say teh bank will acccept you only if you get all these extra coverages. Is this legal?

Answer: it is completely illegal to do this. The salesman knows he has you by the b///s. They may decide not to give you the loan if you dont buy the stufrf - so I guess I would just buy it but just so you know it is illegal to require this in order to obtain the loan. That I am sure of. In fact - the GAP contract will state the same thing oin the actual contract you recieve. I actually sell GAP insurance in every state except New yourk because it is so cheap to buy there (I think it should cost you about $100) all of the aftermarket products that they sell you can be cancelled.

Question: How much would auto insurance normally cost for one person and a 98 honda accord in new york?

Answer: Depends on their credit, their driving record including tickets, accidents, violations, and how long they've been licensed, and which city in NY they are living in - not to mention, are you talking minimum liabiltiy only, or collision & comp on the car? You're going to need to get a real quote from a local agent, as you're probably not going to post all that information for the world to see.

Question: can my child be under my auto insurance policy in a different state? she is in new york, i will be in SC?

Answer: In a word, no! Unless she is a full-time student, and you own the car, which would then be registered to your home address. She would apply for student status with NY. If she takes a summer job, chances are the car would then have to be insured in her name in NY, though.
